NO PURCHASE NECESSARY TO ENTER OR WIN.

PURCHASE WILL NOT INCREASE YOUR CHANCE OF WINNING.

BY PARTICIPATING IN THIS CONTEST, YOU ACCEPT AND AGREE TO BE BOUND BY THESE “OFFICIAL RULES” AND THE DECISIONS OF SPONSOR WHICH ARE FINAL AND BINDING IN ALL RESPECTS.

CONTEST IS NOT OPEN TO RESIDENTS OF QUEBEC.

Message and data rates apply. You may be charged by your wireless carrier for submitting an entry via mobile phone. Be sure to check your wireless carrier’s pricing plan before participating. Not all mobile devices offer wireless Internet access; and, wireless Internet access may not be available in all areas.

 

  1. SPONSOR

The FRESHBOOKS – #WORKANYWHERE CONTEST (the “Contest”) is sponsored by 2ndSite Inc. d/b/a FreshBooks (the “Sponsor”), 1655 Dupont Street Suite 250, Toronto, Ontario, Canada.

  1.  ELIGIBILITY

The Contest is open to those who are at least 18 years old (“Participants”) and submit an original image of their workspace. Employees, officers and directors of Sponsor, its parent company, subsidiaries, affiliates, and agencies are not eligible to enter or win. In addition, members of the immediate family (i.e., parent, sibling, child, spouse) of such persons are also ineligible.

  1.  HOW TO ENTER

NO PURCHASE NECESSARY. PURCHASE WILL NOT INCREASE YOUR CHANCE OF WINNING.

General Requirements

Contest opens 6:00AM PST March 1, 2016 and closes at 12PM PST March 15, 2016 (“Contest Period”). Participants must upload an original photo of how they work anywhere during the Contest Period through Instagram. Participants must tag @freshbooks and #workanywhere in the comments or caption of their photos. Participant can submit one (1) original image per day for the duration of the contest period.

In addition to the above requirements, all Participants must abide by these General Requirements:

  1. Your Entry must be in English
  2. Your Entry must not:
  3. Violate applicable law or the rights of any third party (including trademark, copyright, right of privacy or publicity);
  4. Depict hatred;
  5. Be in bad taste or include the consumption of alcohol beverages or drugs;
  6. Denigrate (or be derogatory toward) any person or group of persons or any race, ethnic group, or culture;
  7. Threaten a specific community in society, including any specific race, ethnic group, or culture;
  8. Incite violence or be likely to incite violence;
  9. Contain vulgar or obscene language or violence;
  10. Contain pornography, obscenity, or sexual activity; or
  11. Disparage or adversely affect the business reputation of the Sponsor or its services.

{Sponsor shall determine in its sole discretion whether an Entry is in compliance with the preceding requirements; and, Entries which are not in compliance will be disqualified. If an Entry is in compliance with the preceding requirements, the content of the Entry will not be taken into account in the winner selection procedure/the live draw.}

PARTICIPANTS’ ENTRIES REPRESENT SOLELY THE VIEWS/OPINIONS OF THE INDIVIDUAL PARTICIPANT AND DO NOT REFLECT THE VIEWS/OPINIONS OF SPONSOR IN ANY MANNER. SPONSOR WILL NOT REVIEW ANY PARTICIPANT ENTRIES PRIOR TO POSTING AND EXPRESSLY DISCLAIMS ANY LIAIBILITY IN CONJUNCTION WITH SAME.

By submitting an Entry you agree that Sponsor has the non-exclusive, irrevocable, perpetual, worldwide, royalty-free, transferable, sublicenseable right and license (subject only to the rights of Twitter or Facebook) to use your Entry in whole or in part, commercially or non-commercially in any media known or unknown in perpetuity, worldwide, including the right to publish and display the Entry for advertising and publicity, and to edit and make derivative works, all without additional review or compensation. Additionally, you agree that Sponsor may post your Entry, including your name on its sponsored websites and/or third-party sites. You further waive any “Moral Right of Authors” (Droit Moral) in the Entry and agree, upon Sponsor’s request and without compensation, to sign any and all necessary and appropriate documents so as to effect, perfect or record such grant of license rights.

Illegible or incomplete entries will be disqualified.

Your entry may be disqualified, at the sole discretion of Sponsor if you attempt to enter through any means other than by the submission methods herein, if you disrupt the Contest or circumvent the terms and conditions of these Official Rules, or violate Terms of Service for Twitter or Facebook,,. If any of the above occurs, Sponsor has the right to remedy any such action, disruption, or circumvention in a manner to be solely determined by Sponsor. Sponsor’s failure to enforce any provision of these Official Rules in a given circumstance shall not constitute a waiver of rights by Sponsor.

  1. PRIZES & WINNER SELECTION

Three (3) prizes are available in total. Each is valued up to a maximum $500. No prize substitution is allowed. Winners are solely responsible for any and all applicable federal, state, and local taxes. Limit of one prize (of no more than a value of $500) per person.

Prizes consist of the following:

1 prize of “$500 worth of expenses” to help participant work on the go

1 prize of “$200 worth of expenses” to help participant work on the go

1 prize of “$100 worth of expenses” to help participant work on the go

Potential winners will be selected at 5:00PM EDT March 15, 2016. Potential winners will be selected by Sponsor. Sponsor will attempt to contact potential winners through direct message on Facebook or Instagram. Sponsor will attempt to contact potential winners up to a maximum of three (3) times between 5:00PM EDT March 16, 2016 and 5:00PM EDT March 18, 2016. Should the Sponsor fail to reach the selected potential winner within this time frame, an alternate potential winner will be selected. This process will continue until there are potential winners for all prizes.

  1. CONDITIONS OF PARTICIPATION

In order to be named a Winner, each potential winner must complete an affidavit of eligibility, a liability release and a publicity release (where lawful) indicating: (i) acceptance of, and agreement to abide by these Official Rules; (ii) agreement to waive any legal claims against and to release Sponsor and its affiliates, directors, officers, employees and shareholders from any and all liability, loss, or damage arising from participation in the Contest (and/or the acceptance, possession, or use of a prize awarded through the Contest, including, but not limited to, claims for product liability, personal injury, breach of contract, and negligence; (iii) confirmation that participant meets and will abide by all eligibility requirements; and (iv) winner’s consent to the use of his/her name, image, likeness, and related personal information, for publicity materials related to the Contest and/or Sponsor and Sponsor’s products and services. A copy of the affidavit of eligibility/release will be emailed to potential winners prior to announcement. If a potential winner does not agree to the terms in the affidavit, potential winner forfeits their prize.

  1. GENERAL

Sponsor is not responsible for incomplete, illegible, misdirected, misprinted, late, lost, damaged, stolen, or intercepted Contest entries/tweets; failed attempts to notify a winner of any live draw; or for lost, interrupted, inaccessible or unavailable networks, servers, satellites, Internet Service Providers, websites, or other connections; or for miscommunications, failed, jumbled, scrambled, delayed, or misdirected tweets, or computer, telephone or cable transmissions; or for any technical malfunctions, failures, difficulties or other errors of any kind or nature; or for the incorrect or inaccurate capture of information, or the failure to capture any information; or for damage to a Participant’s or any other person’s mobile device in conjunction with Contest participation. Sponsor reserves the right in its sole discretion to disqualify any individual who is found to be tampering with the entry process or the operation of the Contest, or to be acting in violation of these Official Rules, or to be acting in an unsportsmanlike or disruptive manner, or with the intent to disrupt or undermine the legitimate operation of the Contest, or to annoy, abuse, threaten or harass any other person, and Sponsor reserves the right to seek damages and other remedies from any such person to the fullest extent permitted by law.

Force Majeure. If, for any reason, the Contest (or any part thereof) is not capable of running as planned by reason of any causes beyond the control of Sponsor which, in its sole opinion, corrupt or affect the administration, security, fairness, integrity or proper conduct of the Contest (e.g., unauthorized human intervention, fraud, riot or natural disaster), Sponsor reserves the right at its sole discretion to cancel, terminate, modify or suspend the Contest and make the prizes available to be won in a manner which is fair, equitable and in accordance with these Official Rules, as determined by Sponsor in its sole discretion. Notice of such action by Sponsor will be posted at www.freshbooks.com.
